This Privacy Policy describes how we collect, use, disclose, and protect your Personal Data (as defined below) when you use our website located at www.x-pactactical.com. and other sites or platforms where we display this Privacy Policy (each, a “Site”) and the data, text, and other materials that are made available via the Site (the “X-Pac® Tactical Materials”).

This Privacy Policy applies to information we collect through the Site for our own purposes, including when we are the Controller of your Personal Data for the purposes of the General Data Protection Regulation 2016/679 (“GDPR”) and any implementing legislation or legislation having equivalent effect in the UK. This policy does not apply to information we collect through any other means, and does not describe how we process Personal Data on our customers’ or any other person’s instructions (in other words, as a processor).

2. A Note About Children

We do not intentionally solicit or gather Personal Data from visitors who are under the age of 13. If a child under 13 submits Personal Data to us and we learn that the Personal Data is the information of a child under 13, we will attempt to delete the information as soon as possible. If you believe that we might have any Personal Data from a child under 13, please email us.

3. User Representations

If you are using the Site on behalf of another party, you represent and warrant that: (i) you have all rights, consents, and permissions to do so; and (ii) that you have obtained such party’s express consent and agreement to this Privacy Policy. In the event that any subscribing entity and/or third party alleges that they were unaware of or did not consent to this Privacy Policy, you acknowledge and agree that we are not responsible for any such activities (including any damages resulting therefrom).

4. Information We Collect

  • Types of Information We Collect

    We may collect “Personal Data,” meaning data that allows someone to identify or contact you, including, for example, your name, address, telephone number, e-mail address, as well as any other non-public information about you that is associated with or linked to any of the foregoing data. We may also collect “Anonymous Data,” meaning data that is not associated with or linked to your Personal Data. Anonymous Data does not, by itself, permit the identification of individual persons.

  • Information You Provide

    We collect the information you voluntarily provide to us through the Site or otherwise. For example:

    • If you provide us feedback or contact us via email, we will collect your name and email address, as well as any other content included in the email, in order to send you a reply.
    • If you opt-in to receive and engage with our email communications, we will collect marketing data, such as your preferences for receiving our marketing communications and details about your engagement with them.
    • We may also collect Personal Data at other points on the Site that state that personal information is being collected.

    We ask that you do not provide us with any sensitive personal information about you or Special Category Personal Data (as defined in GDPR). This includes information related to racial or ethnic origin, political opinions, religion or other beliefs, health, biometrics or genetic characteristics, or trade union membership, or any criminal background information.

  • Information Provided by Affiliates

    We may receive information about you from other companies that are owned by or under common control as Dimension-Polyant, Inc., including with our current and future parent companies (“Affiliates”).

  • Information Collected Via Technology

    We collect certain information automatically using various technologies. For example:

    • Log Files: Like most websites, we gather certain information automatically and store it in Log Files. Log Files enable us to gather statistics about our users’ browsing habits. This helps us determine (among other things) how many and how often users have access or use our Site, which pages they have visited, and other similar data.
    • Pixel Tags: We may use “Pixel Tags” (also referred to as clear Gifs, Web beacons, or Web bugs). Pixel Tags are tiny graphic images with a unique identifier, similar in function to Cookies, that are used to track online movements of Web users. We may use Pixel Tags to monitor user behavior, deliver cookies, collect information, count visits, understand usage and campaign effectiveness, and to tell if a recipient has opened and acted upon an email.
    • Cookies: Cookies are small data files stored on your computer or mobile device by a website. Among other things, cookies help us improve our Services and your experience, see which areas and features of our Services are popular, and count visits. We may use both session Cookies (which
      expire once you close your web browser) and persistent Cookies (which stay on your computer until you delete them) to provide you with a more personal and interactive experience on the Site. The Site may use the following types of cookies:
      • Necessary Cookies: Enable basic functions and are necessary for the proper functioning of the website.
      • Functional Cookies: Allow our website to remember choices you make, maintain your preferences over time, and recognize you when you return to the website. These cookies help us to personalize the website for you.
      • Analytics Cookies: Allow us to understand how visitors use our website. For example, these cookies collect information regarding the number of visitors to our website, the sites that referred them to our website, and the pages that they visited on our website. Performance cookies also allow us to analyze traffic to understand how our website is performing.
      • Advertisement Cookies: Collect data about your online activity and identify your interests so that we can score leads and provide you with web and email content that we believe is relevant to you.
    • Google Analytics: We use Google Analytics to help analyze how users use the Site. Google Analytics uses Cookies to collect information such as how often users visit the Site, what pages they visit, and what other sites they used prior to coming to the Site. Google Analytics collects only the IP address assigned to you on the date you visit the Site, rather than your name or other personally identifying information. We do not combine the information generated through the use of Google Analytics with your Personal Data.
    • Advertising Platforms: We use platforms like Google Ads, Meta (Facebook/Instagram), and LinkedIn to deliver personalized advertisements we think will interest you and to measure the effectiveness of our campaigns. These platforms may use cookies, pixels, and other technologies to collect data about your browsing activity, including pages visited, actions taken on our website, and interactions with advertisements.

    As discussed below under “Your Privacy Choices,” you have choices with respect to how and whether we process some of your information.

5. Use of Your Personal Data

We use Personal Data collected through the Site for the purposes described in this Privacy Policy or as otherwise disclosed to you. For example, we may use your Personal Data in the following ways:

  • to operate and provide improved administration of the Site;
  • to improve the quality of experience when you interact with the Site;
  • to send you follow-up communications when you contact us via e-mail, submit feedback, or post on the Site; and
  • to send you administrative e-mail notifications, such as updates regarding the Site, security, or support and maintenance advisories.

We may create Anonymous Data records from Personal Data by excluding information (such as your name) that makes the data personally identifiable to you. We use this Anonymous Data to analyze request and usage patterns so that we may enhance the content of, and improve navigation on, the Site. Anonymous Data may be used for any
purpose, including to build and improve the Site, and we may disclose Anonymous Data to third parties in our sole discretion.

6. Disclosure of Personal Data

We do not sell your Personal Data to third parties for money or other valuable consideration. However, may share your Personal Data with third parties as described in this Privacy Policy, including:

  • With your consent, including if we notify you through our Services that the information you provide will be shared in a particular manner and you provide such information;
  • With third party vendors, consultants, and other service providers who are working on our behalf and need access to your information to carry out their work for us, including to assist us with data analytics, marketing, website hosting, advertising, and technical support. For example, we use platforms like Google
    Ads, Meta (Facebook/Instagram), and LinkedIn to deliver targeted advertisements and measure the effectiveness of our campaigns. These platforms may use data collected through cookies and similar technologies to provide personalized advertising. We require these entities to maintain the confidentiality, security, and integrity of the personal information they obtain from us;
  • With our Affiliates such as Dimension-Polyant GmbH, for internal business purposes, to fulfill your orders and other requests, and for other purposes permitted by this Privacy Policy;
  • In connection with, or during negotiation of, any merger, financing, acquisition or dissolution transaction or proceeding involving sale, transfer, divestiture, or disclosure of all or a portion of our business or assets. In the event of an insolvency, bankruptcy, or receivership, Personal Data may also be transferred as a business asset.

We may also disclose your Personal Data if we believe, in good faith, that such disclosure is necessary (a) in connection with any legal investigation; (b) to comply with relevant laws or to respond to subpoenas or warrants served on Dimension Polyant; (c) to protect or defend the rights or property of Dimension Polyant or users of the Site; and/or (d) to investigate or assist in preventing any violation or potential violation of the law, this Privacy Policy.

    You may request deletion of your Personal Data by us by emailing us at x-pac@dimension-polyant.com. We will use commercially reasonable efforts to honor your request, but please note that we may be required by law to keep the information. When we delete information, it will be deleted from the active database, but may remain in our archives or back-up systems.

  • Promotional Communications

    We may use your Personal Data to send you updates about our products, including exclusive offers, promotions or new products. If you receive promotional communications from us, you will have the opportunity to “opt-out” by following the unsubscribe instructions provided in the e-mail you receive or by contacting us directly at x-pac@dimension-polyant.com. Despite your indicated e-mail preferences, we may send you service related communications, including notices of any updates to this Privacy Policy.

  • Cookies

    You can manage your preferences regarding cookies using our Cookie Settings. You can also decide whether or not to accept cookies at any time by instructing your browser’s settings to stop accepting Cookies or to prompt you before accepting a Cookie from the websites you visit. Consult your browser’s technical information. If you do not accept Cookies, however, you may not be able to use all portions,
    or all functionality, of the Site. If you have any questions about how to disable or modify Cookies, please let us know at the contact information provided above.

  • Do Not Track

    Your browser may allow you to set a Do Not Track (DNT) signal indicating that you do not wish your online activity to be tracked. We do not currently respond to “do not track” signals from web browsers.

  • Interest-Based Advertising

    To opt out of us processing your data for targeted or cross-context behavioral advertising, please email us. Please note that opting out of targeted advertising from us in this way will only stop targeted ads that use our marketing data. You must opt out of other companies’ targeting methods to stop others from sending you targeted advertising.

    You can also manage your preferences or opt out of targeted advertising through platform-specific tools or industry opt-out mechanisms:

8. Your Rights

  • UK and EEA Residents:

    If you reside in the UK or EEA, we are required to have a “legal basis” for each of the purposes for which we use your Personal Data. The primary legal basis of our processing of your Personal Data as described in this Privacy Policy is our legitimate interests, where those interests are not overridden by the impact on you (unless our processing is otherwise required or permitted by law). In certain
    cases, we may also process your Personal Data based on your consent. Where we rely on consent, you have the right to withdraw this consent at any time. Withdrawal of consent will not affect the lawfulness of processing based on consent before its withdrawal. If you have questions about the legal basis of how we process your personal information, please contact us at the address or phone number above.

    In addition, residents of the UK and EEA have certain rights regarding their Personal Data and may, in certain circumstances, ask us to take the following actions in relation to such data:

Only you, or an agent legally authorized to act on your behalf, may make a request related to your personal information. After submitting a request, we may ask you to provide information that
    will enable us to verify your identity in order to comply with your request. Please note that we may deny an opt-out request if we have a good faith, reasonable belief that the request is fraudulent. Further, in many instances, we do not collect types of personal information that enable us to identify you.

  • Data Transfers

    We may transfer personal data outside your jurisdiction, including to the United States. For EU data subjects, we use appropriate safeguards to ensure adequate protection for your data.
